Attorney Schwartz Interviewed About Greyhound Bus Crash

On January 2, 2019, a Greyhound bus overturned on the Pascagoula Street entry ramp to the I-55 southbound. Emergency responders raced to the scene and helped the passengers safely evacuate the vehicle. While there were no fatalities, 22 of the passengers were transported to local hospitals for treatment. During this time, the driver, 31-year-old Erika Nixon, was administered a Breathalyzer test to determine her blood alcohol concentration (BAC) level. She was charged with misdemeanor driving under the influence and has since pleaded not guilty in court.

WJTV.com recently reported on this incident and explained that many of the survivors sustained physical and mental injuries, including: “lots of concussions, some broken bones, neck and back sprains.” Not only are these passengers struggling through physical rehabilitation programs, they are also fighting to get their missing luggage back from Greyhound Lines, Inc.

The Lawsuit

The victims of this traumatizing event are suing Greyhound Lines, Inc. as well as the negligent driver. To understand the upcoming lawsuit, WJTV interviewed Attorney Richard Schwartz and Attorney Seth Little who are representing the injured parties.

“The injuries are bad enough, but the emotional distress about this supposed scenario, I mean, how do you overcome something like this?” Attorney Schwartz inquired. When asked about Erika Nixon, Attorney Schwartz clarified that “we knew she blew .15 and the legal limit for a commercial driver is .04, so she’s extremely over the limit. We know that to be the numbers, but we don’t have, like you said, we want some verification of the video they may have had when she took the test.” Attorney Schwartz is referring to the video of Erika Nixon completing her breathalyzer test. The legal team has subpoenaed this video to help secure a positive case result for their clients.
